10/23/2007 Comments by Deputy Chief Assistant State Attorney Joe
Grammer on the filing of the latest Girls Gone Wild motion:
At 2:30 this afternoon, we received a 62-page motion and three and one-half
inches of attachments to that motion. State Attorney Steve Meadows has not
yet seen the motion or attachments.
The motion, though referencing allegations of prosecutorial misconduct, is
largely a recap of the defendant’s version of the history of the case and a
description of the conditions of his incarceration.
Interestingly enough, though the motion and attachment were sent, via
Federal Express, to our post office box–thus likely delaying
delivery–several media outlets received the text of the motion via email
from a company which bills itself as "A Strategic Communications Firm."
A prosecutor, like other attorneys, is governed by the Rules of Professional
Conduct. There are also national standards of the American Bar Association
and the National Prosecution Standards promulgated by the National District
Attorneys Association. Nothing in those standards precludes the prosecutor
from making reasonable and fair response to the comments of defense counsel
and others.
When we have had the opportunity to read and digest all of the materials
presented; we will respond appropriately–without the assistance of a media
relations or marketing firm.
We will continue to work to protect the right--of the defendant and of the
State–-to a fair trial in this matter.
